Terms applicable to the use of the JobCroissant platform — US

Preamble
These General Terms and Conditions (hereinafter the "Terms") govern access to and use of the JobCroissant platform (hereinafter the "Platform"), accessible at jobcroissant.com, published by Rolework SASU. Use of the Platform implies full and complete acceptance of these Terms. If you do not accept these Terms, please do not use the Platform.

Article 2 – Definitions
For the purposes of these Terms, the following terms have the meanings set out below:
- "Platform" means the JobCroissant website, accessible at jobcroissant.com, and all services offered thereon.
- "Publisher" means Rolework SASU, the publisher of the Platform.
- "User" means any person accessing the Platform, whether as an Advertiser or a Candidate.
- "Advertiser" means any professional (natural or legal person) who publishes or wishes to publish a Listing on the Platform.
- "Candidate" means any person viewing Listings published on the Platform with a view to applying for a job.
- "Listing" means a job offer published by an Advertiser on the Platform.
- "Services" means all services offered by the Platform, including the publication and distribution of Listings.
Article 3 – Purpose
The purpose of these Terms is to define the terms and conditions for access to and use of the JobCroissant Platform, a platform connecting Advertisers in the bakery and pastry sector with Candidates.
The Platform acts exclusively as a technical intermediary. It is not a party to any employment contract that may be entered into between an Advertiser and a Candidate.
Article 4 – Terms of Use
4.1. Access to the Platform
Access to the Platform is open to any User with Internet access. Use of the Platform for the purpose of publishing Listings is reserved for professionals acting in the course of their business activities.
4.2. Acceptance of Terms
Use of the Platform implies unreserved acceptance of these Terms. The Advertiser acknowledges having read these Terms prior to any order and accepts them without reservation.
4.3. Amendment of Terms
The Publisher reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date of the order placed by the Advertiser.
Article 5 – Job Posting Rules
5.1. Listing Content
The Advertiser undertakes that the content of its Listings shall:
- comply with applicable law, including the labor laws of the country where the job is performed;
- contain no prohibited discriminatory content (origin, sex, age, family status, health, disability, political opinions, union activities, membership or non-membership of a particular ethnic group, nation, race or religion);
- correspond to a real and current job offer;
- not be misleading, false, or harmful to the interests of third parties.
5.2. Advertiser Responsibility
The Advertiser is solely responsible for the content of its Listings and the information it provides. It indemnifies the Publisher against any claim, action or recourse by third parties arising from the content of its Listings.
5.3. Moderation and Removal
The Publisher reserves the right, at its sole discretion and without notice, to refuse publication of a Listing, modify its content, or remove it from the Platform, particularly when it violates these Terms, applicable law, or public policy.
5.4. Publication Duration
Unless otherwise stated, each Listing is published for a period of thirty (30) days from its effective publication on the Platform.
Article 6 – Terms of Sale
6.1. Services Offered
The Publisher offers the following Listing publication services:
- Standard Listing: publication for 30 days with access to basic features.
- Premium Listing: publication for 30 days with featuring in search results, enhanced visual appearance, and the option to add a company logo.
6.2. Order Process
Orders are placed online according to the following process: (i) creation of the Listing by the Advertiser; (ii) choice of service type (Standard or Premium); (iii) validation and secure payment via Stripe; (iv) verification and moderation by the editorial team; (v) publication of the Listing.
6.3. Editorial Validation
All Listings are subject to editorial validation prior to publication. This validation process is completed within a maximum of twenty-four (24) business hours. The Advertiser is notified by email when its Listing goes live.
Article 7 – Pricing and Payment
7.1. Prices
Service prices are displayed on the Platform in euros (€) or dollars ($) depending on the country. Prices shown are exclusive of taxes. Applicable taxes (VAT, sales tax, etc.) are calculated and added at checkout based on the billing information provided by the Advertiser and applicable regulations.
7.2. Payment Methods
Payment is made online by credit card via the secure Stripe solution. Payment is due immediately upon ordering. The transaction is confirmed only after payment acceptance by Stripe.
7.3. Invoicing
An invoice is automatically issued and sent by email to the Advertiser after payment confirmation. The Advertiser may enter its VAT number during the payment process to have it appear on the invoice.
Article 8 – Right of Withdrawal
⚠️ Important Notice
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of services fully performed before the end of the withdrawal period and whose execution began with the prior express consent of the consumer and express waiver of the right of withdrawal.
By confirming the order, the Advertiser:
- acknowledges that performance of the Service begins immediately after payment confirmation;
- expressly waives the right of withdrawal provided for by applicable legal provisions.
8.1. Cancellation and Refund
In view of the foregoing, no cancellation or refund is possible once the Service has started. However, if the Listing is rejected by the Publisher for non-compliance with these Terms or for legitimate reasons, the Advertiser will be fully refunded the price paid.
Article 9 – Liability
9.1. Role as Technical Intermediary
The Platform acts as a technical intermediary within the meaning of Article 6 of French Law No. 2004-575 of June 21, 2004 on Confidence in the Digital Economy (LCEN). As such, the Publisher is not subject to any general obligation to monitor published content.
9.2. Limitation of Liability
The Publisher shall not be held liable for:
- the content of Listings published by Advertisers;
- the absence of applications or the failure of a recruitment process;
- the quality, relevance, or accuracy of information provided by Advertisers or Candidates;
- relationships between Advertisers and Candidates, including any disputes arising between them;
- any temporary or permanent interruption of the Service for technical, maintenance, or force majeure reasons.
9.3. Best Efforts Obligation
The Publisher undertakes to use all reasonable means to ensure the availability and proper functioning of the Platform. This obligation is a best efforts obligation and not an obligation to achieve a specific result.
Article 10 – Intellectual Property
All elements comprising the Platform (structure, texts, logos, images, graphics, databases, software, etc.) are protected by intellectual property law and remain the exclusive property of Rolework SASU or its partners.
Any reproduction, representation, modification, publication, or adaptation of all or part of these elements, by any means or process whatsoever, is prohibited without the prior written authorization of Rolework SASU.
Article 11 – Personal Data Protection
The Publisher processes Users' personal data in accordance with Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and French Law No. 78-17 of January 6, 1978, as amended, on data processing, files, and freedoms.
For any request relating to the exercise of rights of access, rectification, erasure, restriction, portability, or objection, the User may contact the Publisher at: jobcroissant@rolework.com.
Article 12 – Governing Law and Jurisdiction
These Terms are governed by French law.
In the event of a dispute relating to the interpretation, validity, or performance of these Terms, the parties shall endeavor to find an amicable solution. Failing amicable agreement within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Paris, unless mandatory legal provisions provide otherwise.
